These Terms of Service govern the use of niyastore.in and purchases made from Niya Store.

By visiting the website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy. If you do not agree, please do not use the website.

Eligibility

You must be legally capable of entering into a contract.

If you are under 18 years of age, you may use the website or place an order only with the involvement and approval of a parent or lawful guardian.

Acceptable use

You must not:

• Use the website for an unlawful or fraudulent purpose;

• Attempt unauthorised access to the website or another customer’s account;

• Introduce malicious software or interfere with website security;

• Scrape, reproduce or commercially exploit store content without permission;

• Submit false contact, billing or delivery information; or

• Misuse promotional offers, payment facilities or Cash on Delivery services.

Product information

We make reasonable efforts to display product descriptions, dimensions, features, photographs and colours accurately.

However, colours may appear differently because of photography, lighting and individual screen settings. Product packaging may also change without affecting the product.

Minor colour differences, packaging changes and differences based on personal expectations do not make a product eligible for return.

Please review all available product information before ordering.

Prices and payments

Prices are displayed in Indian Rupees unless stated otherwise.

Applicable taxes, delivery fees, Cash on Delivery charges and discounts will be shown at or before checkout.

We may correct genuine pricing, description or listing errors. If an error affects an order already placed, we will contact you and offer cancellation with a full refund rather than charge a different amount without your consent.

Online payments are handled by third-party payment providers under their applicable terms and security procedures.

Cash on Delivery may be unavailable for certain products, PIN codes, order values, customers or addresses.

Order acceptance

An order acknowledgement does not necessarily mean that an order has been accepted or dispatched.

We may decline or cancel an order because of:

• Product unavailability;

• Pricing or listing errors;

• Payment failure;

• Suspected fraud or misuse;

• Delivery restrictions;

• Quantity restrictions;

• An inability to confirm a Cash on Delivery order; or

• Other legitimate operational reasons.

If payment has already been collected for an order we cancel, the amount collected will be refunded.

Order cancellation

A customer may request cancellation before dispatch by contacting support@niyastore.in or +91 9818666797.

Cancellation cannot be guaranteed after an order enters fulfilment or has been dispatched.

Once dispatched, an order is not eligible for cancellation or return except where a damaged or incorrect product is delivered in accordance with our Return and Refund Policy.

Delivery

Order processing, shipping charges, delivery estimates, tracking and failed-delivery provisions are governed by our Shipping Policy.

Delivery dates are estimates and may be affected by circumstances beyond our reasonable control.

Returns and refunds

Returns are accepted only for damaged products or incorrect products delivered, subject to:

• Notification within 3 calendar days of delivery;

• A clear, continuous and unedited unboxing video;

• Submission of the required order and product evidence; and

• Verification by Niya Store.

We do not offer returns or exchanges because a customer changed their mind, did not like the product, did not like the colour, ordered incorrectly or no longer needs the product.

Promotions

Promotional offers are subject to their stated period, eligibility conditions and stock availability.

Unless expressly permitted, promotions cannot be combined, exchanged for cash or applied retrospectively to an earlier order.

Intellectual property

The Niya Store name, website design, text, graphics, product photographs, logos and other store content are owned by or licensed to us and protected under applicable law.

Website content may be used only for personal shopping. It may not be copied, reproduced, distributed or commercially exploited without written permission, except where permitted by law.

Third-party services

Our store is hosted by Shopify and may use third-party payment, delivery, fulfilment, analytics, advertising and communication services.

Third-party services may have their own terms and policies. Niya Store is not responsible for an external website or service that it does not control.

Disclaimer and limitation of liability

Nothing in these Terms excludes a customer right or remedy that cannot lawfully be excluded under applicable Indian consumer law.

To the extent permitted by law, Niya Store will not be liable for indirect or consequential loss resulting from use of the website or a product.

Our aggregate liability for a claim relating to a purchase will not exceed the amount paid for the affected product, except where greater liability is required by applicable law.

Governing law and disputes

These Terms are governed by the laws of India.

Courts having jurisdiction in Faridabad, Haryana will have jurisdiction, subject to any mandatory consumer forum, commission or other remedy available to a customer under applicable law.

Before starting formal proceedings, please contact us so that we can attempt to resolve the matter promptly.

Changes to these Terms

We may update these Terms from time to time.

Changes apply from the date the revised Terms are posted and will not retrospectively reduce the rights attached to an order already accepted.
